The man accused of shooting three people at New Somerset Hospital made another appearance in the Cape Town Magistrate’s Court on Thursday, 30 June.
NEW SOMERSET HOSPITAL SHOOTER APPEARS REMOTELY
Jean-Paul Carl Malgas appeared remotely via the Audio Visual Remand (AVR) system on Thursday.
The last time he appeared in person his legs were shackled and he was handcuffed.
When the presiding officer asked why this was the case, the court heard that the decision was made in the interest of safety given the crime Malgas is accused of. The court also heard that the accused suffers from severe depression and is suicidal.
He allegedly shot and killed Constable Donay Phillips of the Sea Point police station and two patients at New Somerset Hospital on Saturday, 7 May.
On Thursday, the court heard that Malgas’ health had improved. He said he was receiving treatment and his lawyer requested that he be physically present in court at the next appearance, according to National Prosecuting Authority (NPA) spokesperson Eric Ntabazalila.
State Advocate Adenaan Gelderbloem said that several reports, including DNA reports, a prima residue report and two post-mortem reports, witness statements, ballistic reports and an identity parade, were outstanding.
The matter was postponed to 12 August for further investigation. Thus far, the State has received one autopsy report, and between four and five witness statements.
Malgas faces three charges of murder, illegal possession of a firearm, ammunition and robbery. He previously abandoned his bail application, however, if he changes his mind the State will oppose him, said Ntabazalila.
As previously reported, the accused’s lawyer confirmed that he was a member of the South African Police Service (SAPS) between 2002 and 2007 and has been unemployed since he left the service.
