Witness to testify Kelly Khumalo allegedly shot Senzo Meyiwa

Defence lawyer Advocate Malesela Teffo told the Pretoria High Court that a crucial eyewitness will be brought in to testify that Senzo Meyiwa was accidentally shot by his then girlfriend, Kelly Khumalo.

Teffo revealed this while he was cross examining forensic officer, Sergeant Thabo Mosia who was amongst the first to arrive at the crime scene in Vosloorus when Meyiwa was shot.

On Tuesday, the contents of the second docket in the Senzo Meyiwa murder case took centre stage at the Pretoria High Court.

Advocate Teffo revealed that the National Prosecuting Authority (NPA) wanted to pursue a case against the seven people who were in the house the night Meyiwa was murdered.

“The leading investigator in this case says it is nonsensical that people entered the house that night and shot Meyiwa,” Teffo said

On Wednesday, the court heard that a witness will come to testify that Meyowa was allegedly shot by Kelly Khumalo.

“I put it to you Mr Mosia that an eyewitness will come and testify that Senzo Robert Meyiwa was allegedly shot by Nonhlanhla Kelly Khumalo by mistake,”he said.

Teffo further said the same witness will testify that the firearm Kelly Khumalo used to shoot Meyiwa came with Chicco Twala’s son, Longwe and that the firearm is a revolver and not a 9mm pistol as the State alleges.

The indictment for the case the Director of Public Prosecutions in the South Gauteng division stated that the relevant people who are supposed to appear before the court are:

Longwe Twala (accused 1), Kelly Khumalo (accused 2), Gladness Khumalo (accused 3), Zandie Khumalo (accused 4), Tumelo Madlala (accused 5), Mthokozisi Twala (accused 6) and Maggie Phiri (accused 7).

The above named people were accused of murder and defeating the ends of justice.

The indictment further stated that after realising that Meyiwa was shot, accused 1 to 6 hatched a plan to say that armed robbers had entered the house and shot Meyiwa.

Accused 7 is said to have cleaned the scene prior to the arrival of the police while Meyiwa was rushed to hospital.

On Tuesday, Mosia said the delays in reporting the murder of Senzo Meyiwa may have caused the crime scene to be contaminated.

Mosia reportedly arrived 4 hours after the incident. He also alleged that the late Major-General Ndlovu did not give him the address to Kelly Khumalo’s home. He instead was told to go to Botshelo Hospital where Meyiwa was reportedly rushed” to in an attempt to “save his life”.

Photos that Ndlovu took on the crime scene  were also shown in court on Wednesday.

Defence lawyer for accused 5 in the case, Advocate Mshololo also cross examined Ndlovu for the first visit to the crime scene.
